Nuances of accrual of sick leave in case of termination of employment

The calculation of the average daily wage for the provision of assistance in connection with temporary disability is carried out in accordance with the norms of the Procedure for calculating the average wage (income, financial support) for the calculation of payments under the mandatory state social insurance, approved by the Resolution of the CMU dated 09/26/2001 No. 1266.

Government Resolution No. 1350 dated 02.12.2022 amended this Procedure, which entered into force on January 1, 2023. In particular, paragraph 3 of the Procedure provides for an exclusive list of valid reasons for which unworked calendar days are excluded from the calculation period when calculating the average salary. The period of suspension of the employment contract is included in the list of specified reasons from January 1, 2023.

That is, during the calculation of benefits in connection with temporary incapacity for work for insured events that began after this date, the calendar days of suspension of the employment contract are removed from the calculation period. In the case of calculation of the corresponding benefit for insured events that began before January 1, 2023, such periods are not removed.
