WOMEN WILL BE ABLE TO INDEPENDENTLY DETERMINE THE START DATE OF MATERNITY LEAVE: THE LAW IS ADOPTED

On July 13, 2023, the Verkhovna Rada generally supported draft law No. 9271 “On Amendments to Certain Legislative Acts of Ukraine Regarding the Peculiarities of Using Leave in Connection with Pregnancy and Childbirth.” 267 People’s Deputies voted for him.

The draft law proposed to grant the right to working women, in the absence of medical contraindications, at their own request, to start leave in connection with pregnancy and childbirth later than 70 (90) days before the expected date of childbirth, as well as to transfer unused vacation days to the period after childbirth. At the same time, the total duration of such leave, provided for by law, will not change.

For example, if the specified changes are adopted, a woman will be able to use 20 days of leave before the expected date of childbirth and 106 days – after, the total duration of the leave will remain unchanged and will be 126 days.

If the woman does not wish to start such leave later or has medical contraindications, the “standard” distribution of leave days before and after childbirth will apply.

The Law is expected to enter into force on the day following its publication.
